What is House Bill 138?

Sheriff Sales

All sales are pursuant to the provisions of the Ohio Revised Code. Our sale is held every Friday morning promptly at 10:00 A.M. in the cafeteria area located on the first floor in the People's Community Center building, 597 Park Avenue East, Mansfield, Ohio 44905. There are no Sheriff‘s Sales on Federal Holidays. The official listing of upcoming property to be sold can be found in The News Journal (five weeks in advance of the sale). The list on this Web Site is for informational purposes only. A complete list of withdrawals are read at the beginning of each respective Sheriff’s Sale weekly.

Conditions of the Sale

All bids begin at 2/3 of the appraised value of the property unless dictated otherwise by the Courts. If you purchase a property, you will need either a cashier’s check or personal check in the amount of the required deposit. Balance will be due according to the terms of the sale. All sales stipulate "buyer beware". Meaning, that the inside of the house may not have been examined by an appraiser because access was not available, and the sale could be set aside because of significant damage inside the house. If you are the successful bidder, a Purchaser Information Form must be filled out prior to the purchase of the property. A deed will be prepared by the Plaintiff’s Attorney once a copy of your confirmation of sale is prepared. Deeds take approximately 4 to 6 weeks.

Can a pre-approved loan take the place of the down payment?
No. The terms of the sale according to state law are cash.

Can I go through the property?
No. The property is owned by the defendant until the sale has been confirmed by the court. The buyer purchases any foreclosed property caveat emptor, which means, "let the buyer beware" or that you are buying the property sight unseen. Remember, deposits are not refunded.

When can I go into the property?
You may enter the property once the court has confirmed the sale, you have paid for the property in full and you have received the deed and the deed has been recorded and conveyed. Until that time, you may not enter the property, change the locks, have occupants removed, mow the yard, etc.

What happens if the property is occupied?
After the confirmation has been filed, you have paid in full and received your deed and have recorded and conveyed the deed, you may contact the occupants and advise them they need to vacate the premises. If they still refuse then the buyer needs to file a writ of possession with the Richland County Clerk of Courts and in turn the Sheriff’s Office will serve the occupants with an order to vacate. If they still refuse to vacate, the buyer then needs to contact a moving company and a lock smith and the moving company will move out the occupants at the buyers expense. The Sheriff’s Office will stand by if this occurs, but usually the occupants leave prior to filing with the Clerks Office.

How can my mortgage company appraise the property for my loan?
The Sheriff’s Office does not have the authority to order the defendant to let anyone inside. The mortgage companies in this area are aware of the problems trying to appraise without going inside. The buyer must contact the mortgage company to work out those details.

Who schedules the closings?
The Sheriff’s Office does not attend closings. It is the responsibility of the purchaser or the purchasers agent to pay the balance due in full when contacted by the Sheriff’s Office. When the balance is paid, the purchaser will receive a Sheriff’s Deed, which then will be recorded by the Sheriff’s Office.

What are the additional costs of the sale, if any?
In a tax foreclosure, the buyer is responsible for the successful bid, deed fee for $50.00, poundage fee, conveyance of the deed for $75.00, and the recording of the deed to be paid to the Sheriff’s Office.

In a mortgage foreclosure, some costs are taken from the sale. The successful bidder is responsible for the deed fee, conveyance fee and the recording fee to be paid to the Sheriff’s Office.

What is a conveyance fee?
A conveyance fee is where the Sheriff’s Office will transfer the sellers name to the buyers name. The fee is $4.00 per every $1,000 dollars of the total sale.

What is a recording fee?
A recording fee is where the Sheriff’s Office will have the Recorder’s record the deed for permanent record keeping. The fee is $28.00 for the first two pages, then $8.00 for each additional page.
